These Terms of Service (“Terms”) govern your access to and use of the website, Adobe Express add-ons, and AI-powered creative tools (including text-to-speech, AI image generation, and AI video generation) provided by NioLeads (“Company”, “we”, “us”, or “our”) (collectively, the “Service”).

1. Acknowledgment

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You represent that you are at least 18 years old. If you are under 18, you may not use the Service.

2. Service description

• Website: public pages, documentation, and support.
• Adobe Express add-ons: apps that run inside Adobe Express and related sessions.
• AI tools: media generation workflows (voice, image, video).

3. Accounts & add-on sessions

Some parts of the Service may require sign-in (for example Google OAuth for add-on API access) or other account mechanisms. You are responsible for maintaining the confidentiality of your access and for all activity under your session.

4. Credits, subscriptions, and payments

Checkout is processed securely by Paddle. Paddle is the Merchant of Record for purchases made through our checkout flows. We do not store full payment card details on our servers.

• Subscriptions: credits may be granted each billing cycle and may be subject to plan rules shown at checkout.
• Top-ups: one-time credit packs may be offered for purchase.
• Pricing: we may modify prices, credits, or allocations over time.

5. Refund policy

We offer a 7-day money-back guarantee. If you request a refund within 7 days of purchase, we will refund only the monetary equivalent of unused credits. Credits already consumed are not refundable.

6. Acceptable use (NSFW restrictions)

The Service includes AI-powered generation. You agree not to use the Service to create, request, upload, store, distribute, or attempt to obtain content that is prohibited below. These rules apply to prompts, reference materials, outputs, and any distribution of outputs.

Prohibited content

• NSFW / sexually explicit: pornography, explicit nudity intended to be prurient, sexual acts, or sexually suggestive content intended for arousal.
• Minors: any sexual or suggestive content involving minors, or content that sexualizes or exploits minors (including fictional or stylized portrayals).
• Non-consensual intimate imagery: deepfakes or intimate content created or shared without consent.
• Harassment or violence: hateful, violent, or harassing content.
• Illegal content or content that violates applicable law.

Prohibited conduct

• Attempting to bypass, evade, disable, or circumvent content policies, safety systems, or rate limits, including “jailbreaks”, hidden instructions, or repeated rephrasing intended to evade moderation.
• Automation or bulk abuse that harms service reliability or other users.
• Misrepresenting the Service as “uncensored”, “unfiltered”, or “unrestricted”.
• Infringing intellectual property or violating third-party rights.

Enforcement

Violations may result in warnings, blocked generations, content removal, suspension or termination of access, and other remedies. Where permitted by law and our policies, we may refuse refunds for abusive usage.

7. User content and responsibility

You are responsible for the prompts, uploads, and outputs you generate and how you use them. You must ensure you have rights to any materials you upload and that your use complies with applicable laws.

8. Third-party providers and AI outputs

We may use third-party service providers (including AI providers) to operate the Service. AI outputs may be inaccurate or inappropriate; you must independently evaluate outputs before relying on them. Do not use the Service as the sole basis for decisions in high-risk contexts (e.g., medical, legal, financial).

9. Disclaimer and limitation of liability

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind to the maximum extent permitted by law.

To the maximum extent permitted by law, our total liability is limited to the amount you actually paid through the Service or 100 USD, whichever is greater.

10. Termination

We may suspend or terminate access immediately if you breach these Terms or if required for safety, fraud prevention, or legal compliance.

11. Changes

We may update these Terms from time to time. Continued use after changes become effective constitutes acceptance of the updated Terms.
